TERMS AND CONDITIONS

The purchase of your travel booking constitutes a contractual agreement between the traveler(s), customer(s), and/or purchaser(s), (collectively as “You” and “Traveler”), and Travel With Class LLC (“We,” “Us,” “Agency,” “Travel Agency”) pursuant to the following terms and conditions (“Terms,” “Agreement”). The lead passenger assumes the responsibility of sharing these Terms with each passenger in their group, including payment of all amounts when due. It is the responsibility of each passenger to read our Terms in its entirety. You agree to be financially responsible for all travel bookings you make with us, whether made on behalf of yourself or for other members of your traveling party. As the purchaser, you remain responsible for the acts and/or omissions of your group under these Terms. You warrant that all information supplied by you on behalf of yourself, members of your traveling party, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with Travel With Class LLC and its third-party suppliers (“Suppliers”), and you acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited. In addition, we reserve the right to modify these Terms. If there is any part of these Terms that you do not agree with, please do not use our travel services.

Please read these Terms closely before using our website (“Website” or “Site”). By accessing, browsing and using this Site, you acknowledge that you have read, understood and agree to comply with the Terms stated here. By accessing this Website or to the extent that you book any travel products or services on this Site or through our Agents, you agree that these Terms shall apply to all such transactions. As a condition of participation, You hereby agrees to now and forever hold harmless and indemnify Travel With Class, LLC, its owners, agents and employees from and against any and all claims, losses, damages, causes of action, suits and liability of every kind, including all expenses of litigation, court costs, and attorney fees, for any property damage, injury, death or losses associated therewith, arising from or in connection with participation in the trip. If you do not accept any part of these Terms, you must discontinue use of this website. You acknowledge and accept these Terms by continuing to use this Website, by submitting an order to or procuring services of Travel With Class, LLC, or by issuing any payment to Travel With Class, LLC.

TRAVEL AGENT

Travel With Class, LLC acts as a travel agent only. We sell various travel related products on behalf of numerous transport and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators, tours and hotels. Travel With Class, LLC does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. Travel With Class, LLC’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider not Travel With Class, LLC. Conditions can change rapidly in a country at any time. It is your responsibility to check the USA Government Travel advisories for your intended destination at https://travel.state.gov/content/travel.html

IMPORTANT CONDITIONS:

Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. You expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase.

CHANGES, CANCELLATION, PRICING, FEES

The credit card holder must email Travel With Class, LLC to change or cancel any portion of the reservation. We are not responsible for any changes or modifications that are made to the reservation without our assistance. All changes are subject to availability/current rates, promotions and terms at the time of change. The travel agent reserves the right to cancel the reservation in case of unforeseen circumstances or force majeure event. Pertaining to the room portion of your trip; once your reservation is made a $150 per person non refundable cancellation penalty will apply, in addition to any resort penalties that may be applicable. If changing or canceling a published flight, a $50 per person Travel With Class, LLC fee will be charged in addition to the applicable airline fee as per the individual airlines terms and conditions.

If making a change, you will be responsible for the fees, plus any increase in cost resulting from the change. Name changes are not allowed at any time on published flights. If Travel Insurance is purchased, it is nonrefundable once purchased. It must be purchased as part of your deposit. If you do not show up for or are considered a No Show for any portion of the reservation a 100% penalty will be assessed and no refund or credit will be issued. If you do not use one of the flights in your reservation the airline will cancel the remaining itinerary. Your credit card will be charged whether you use or do not use the services purchased, including partially used services. Promotional codes hold no cash value. If a promo code is used and changes or cancellation are processed, the discount will not be applied to the future booking.

There may be additional baggage fees. Due to continual changes in airline baggage policies it is suggested that you inquire with your airline’s website for up-to-date fees & information. Travel With Class is NOT responsible for additional fees incurred for baggage or seating. BAGGAGE FEES ARE NOT PART OF AN ALL-INCLUSIVE PACKAGE!

There may also be ticketing, fuel, security, and seat selection surcharges assessed by the airlines at the time of check-in. In addition, government entry and departure fees may apply, depending upon the destination. You are solely responsible for these fees as well as all charges, duties, taxes, assessment and hotel incidentals arising out of your use of the Products and Services available from the Site. Incidental charges include, but are not limited to, charges for telephone and safe access, as well as maid fees and energy surcharges. Travel With Class, LLC reserves the right to correct any pricing errors. Currency converters are based upon various publicly available sources and should be used as guidelines only. Rates may vary based upon your form of payment and may not be accurate.

DEPOSIT BOOKINGS

All deposited bookings are nonrefundable per the booking form and/or the group booking contract. The purchase of travel insurance is strongly recommended and if purchased, the total price of travel insurance will be added to the initial deposit amount. All deposits, final payments and fees are non-refundable and non-transferable. All payments for travel are due prior to departure according to each Supplier’s terms, conditions of booking, or group contract. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations. In some cases, there is NO REFUND once a booking is made and under deposit. Future payments will be automatically charged to the initial credit card used for the deposit payment on the dates noted on your deposit invoice. It is the responsibility of the client to verify that the credit card being used for final payment will be valid on the scheduled due date. The billing contact specified on the Payment submission will be the primary person contacted for any payment issues. Once final payment is made by the client for their trip or the trip they are paying for on behalf of others, their payment is non-refundable and non-transferable. If Travel Protection is purchased the initial deposit and cost of the insurance are non refundable and non transferable if you cancel your trip. In the case of a passenger or client traveling as part of a group booking, cancellation of the reservation after final payment has been made will also be subject to Supplier penalties and liquidated damages as defined in the master group contract for which they are traveling under. In the event of a cancellation or nonpayment, the deposit fee or any payments provided for a trip will not be refunded, transferred or credited. Travel With Class, LLC reserves the right to cancel the booking in the event of non-payment or payment dispute and withhold any portion of the deposit. All standard change, revision, and cancellation policies apply after full payment is received. For Land and Air package reservations: A deposit of the total price of airfare, plus package tax will be required at the time of booking. By using the Travel With Class, LLC’s payment platform to make your deposit and/or final payment you are agreeing to these Terms.

EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF TRAVEL WITH CLASS, LLC OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF TRAVEL WITH CLASS LLC OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, TRAVEL WITH CLASS, LLC RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.

TRAVEL DESTINATIONS

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. Travel With Class, LLC urges passengers to remain informed about current news events, travel prohibitions, warnings, announcements and advisories issued by the United States Government. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/. By offering the sale of travel to particular international destinations, Travel With Class, LLC does not represent or warrant that travel to such points is advisable or without risk and is not liable for damages or losses that may result from travel to such destinations. You acknowledge that the use or enjoyment of this purchase may be hazardous and inherently risky and, to the maximum extent permitted by law, you and the passengers will assume all risk arising out of or in connection to this purchase.

IMPORTANT NOTE REGARDING REQUIRED DOCUMENTS FOR ENTRY

All individuals departing from the United States of America must be in possession of a valid passport. Please check that your passport is valid for 6 months or longer than your intended travel time. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State, or representative government agency of the country to which you are traveling, to confirm the requirements for visas and/or other requirements for admission to your destination. It is your responsibility to ensure you are aware of any health and legal requirements for your travel destinations and to ensure that you carry all necessary documentation. Travelers with passports that are found to be washed, mutilated, or damaged may be refused entry. U.S. citizens should be aware that countries can deny foreigners entry if they have been charged or convicted of a serious crime. If you do not have a passport at time of booking, it is your responsibility to secure one and Travel With Class, LLC is not liable should you not receive it in time, or for any reason. Children under the age of 18 traveling with only one parent or someone who is not a parent or legal guardian should travel with a notarized letter of consent. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A valid government issued ID is required for travel within the USA, however depending on the State of departure or arrival, a passport may be required instead of a driver’s license in addition to health documentation. It is the traveler’s responsibility to provide the correct documents and failure to do so may result in being denied entrance or boarding for the flight. Regrettably, we are unable to refund unused flights, hotel, or add-ons because of denied entrance or boarding situations. TRAVEL INSURANCE

It is strongly recommended that all participants purchase travel insurance to protect against unforeseen events, such as trip cancellations, medical emergencies, or lost/stolen luggage. Travel With Class, LLC will offer information about available travel insurance options, but the decision to purchase lies with each individual participant. Additionally, most health insurance policies do not provide medical coverage for international travel. In order for you to obtain coverage for certain pre-existing conditions or a cancel for any reason policy, your insurance policy must be purchased at the time of booking or shortly thereafter. However, Travel With Class, LLC is not an insurance company and has no responsibility for the submission, payment, denial or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy. Insurance does NOT cover items you purchase outside Travel With Class (i.e. airfare, tours, excursions etc.). By declining to purchase travel insurance, you understand that you are responsible for any penalties and out-of-pocket expenses incurred as a result of cancellation or interruption, emergency medical and transportation, baggage and personal effects, flight and travel accident, quarantine, and/or rental car physical damage. You also understand that you will make your own provisions in the event of an emergency while you are traveling.

DISABILITIES OR SPECIAL NEEDS:

Travelers with disabilities or special needs who may require non-emergency special services, additional support, or accommodation of a disability should advise us in advance of booking, so that we can request assistance or arrange for appropriate services or equipment. In some cases when travelers are unable to use their own wheelchairs, mobility devices, medical equipment, or devices, rental of special equipment or devices may result in additional charges. Airlines may impose charges for additional baggage and may have restrictions on the size of wheelchairs that they can accommodate.

In order to travel with a service animal or emotional support animal, some Suppliers may require advance arrangements and special documentation of the animal’s health and training.

When traveling outside of the United States, laws and regulations will often apply different standards of accommodation for travelers with disabilities or special needs. While we are committed to assisting travelers with disabilities or special needs, Travel With Class LLC is not responsible for the failure of Suppliers in those countries to meet the needs of travelers when the Supplier follows the laws and regulations of the local jurisdiction. Additionally, the laws and regulations of local jurisdictions covering travelers with disabilities or special needs may change without prior advance notice and Travel With Class LLC bears no responsibility in case of changes in the legal or regulatory framework of the places you may visit on your trip.

Certain destinations may have limited medical facilities or limited availability of prescription medications. We recommend that you consult with your health practitioner to discuss the details of your trip. Certain travel insurance plans may provide access to emergency medical care, medical evacuation and replacement of prescription medication. WE RECOMMEND THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE ON ALL BOOKINGS.

Resort Information

Passengers may be required to present a credit card at the time of check-in to provide confirmation of authorized card use or to secure any additional expenses. Some resorts have minimum age requirements and/or citizenship requirements to allow for check-in. If a reservation is booked and the age or citizenship requirements are not met, the customer will be held responsible for all change and/or cancellation penalties that are incurred to make changes. In the event that the number of passengers occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change.

Travel With Class, LLC is not responsible for fees and/or penalties incurred as a result of departure from the resort before the scheduled departure date. No booking credit and/or refund will be granted for departures from the resort before the scheduled departure date. In the event that you do not show for the first night of your reservation and do not notify us of these changes, cancellation of your reservation may occur. Rooms are assigned at the hotel’s discretion and based upon availability. We will provide special requests to the service providers however we cannot guarantee that any special requests will be fulfilled; including but not limited to, bed types, smoking preferences and resort/in-room amenities. Failure to meet special requests does not signify a breach of contract. In the event that the Supplier overbooks their property or for any reason beyond our control, we reserve the right to either provide alternative accommodations of a similar standard or cancel the reservation in full, our option.

If you experience an issue during your trip, you must call us immediately so that we can assist you in resolving your problem. To the extent permitted by applicable law, unless you file any grievances with Travel With Class, LLC within 30 days after the termination of the trip, all parties are released from further liability. Services are provided on an “as is” and on an “as available” basis. All expiration dates listed on the Website are effective at midnight, Central Standard Time.

LIABILITY AND INDEMNIFICATION DISCLAIMER

Travel With Class, LLC is not liable for any act omission of any travel service provider or of any third party. In addition and without limitation, Travel With Class LLC is not responsible for any injury, loss, death, quarantine, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches may not be up to U.S. standards. If due to weather, flight schedules or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner’s risk. The prices of tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice.

You shall indemnify, defend and hold harmless Travel With Class LLC, its officers, employees, agents, partners, Suppliers, and licensors (the “Indemnified Parties”) from and against any and all liabilities, losses, costs, expenses, settlement amounts, and damages (including reasonable attorneys’ fees) incurred by the Indemnified Parties arising out of any suit or proceeding by a third party arising from your participation in the trip, use of Travel With Class LLC’s services, or breach of any representation, warranty, covenant or obligation under these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL TRAVEL WITH CLASS, LLC, OR ITS OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF TRAVEL WITH CLASS, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), HOWEVER CAUSED, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RESULTING FROM THESE TERM, THE USE OF THE SITE, OR THE SERVICES OF TRAVEL WITH CLASS, LLC. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF TRAVEL WITH CLASS, LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS AND LICENSORS EXCEED FIFTY US DOLLARS ($50.00 USD).

TRANSFERS

All flight details need to be submitted via e-mail a minimum of 45 days prior to departure or your transfers will not be confirmed, and your payment will be non-refundable. Any changes to transfers under 24 hours of initial reservation will result in a new charge for service. Suppliers may have additional terms that apply.

TRAVELING WITH CHILDREN

Children under 18 years of age not traveling with both parents or legal guardian(s) may need to present a notarized letter from the absent parent/guardian granting permission to travel outside the United States and provide emergency medical care if necessary. Travel With Class is not responsible for lack of compliance to provide proper documentation to airport authorities. It is the responsibility of the traveler & the traveler’s parents/guardians to provide proper documentation to airport authorities.

TRAVEL DOCUMENTS

Travel documents will be sent to you via an electronic itinerary unless specified to mail to you. Please read through these documents immediately; misprints, misspellings, incorrect dates etc. are not the responsibility of Travel With Class. Included in your travel documents (if airfare is purchased through Travel With Class) are airline electronic ticket receipts (proof of purchase, not boarding passes or actual tickets). Boarding passes are printed at the time of check in; online with the airline directly, or at the airport when showing passport & checking in luggage. It is very important that you take your travel documents with you in addition to passports and a major credit card for any baggage fees that may apply.

AIRLINE SCHEDULE CHANGES & CANCELLATIONS

Occasionally airlines change flight schedules and may even cancel flights entirely. These changes are beyond Travel With Class’s control. In the event that such a situation occurs, Travel With Class will assist you with finding the best possible alternate option(s). If the flight time change is minor (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so). Travel With Class will notify you of major changes. Please Note: there may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. Travel With Class is NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last minute airline flight time changes within 24 hours of departure. Travel With Class is not responsible for changes that may occur within 24 hours of original flight departure time.

RECONFIRM YOUR FLIGHTS

Travel With Class advises you to personally re-confirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last minute changes or delays. Most airlines allow you to check in online 24 hours prior to departure using the “Record Locator” (found in your Travel With Class documents)

AIRLINE CHECK IN

Please check in with your airline at the airport no later than two (2) hours prior to scheduled flight departure time.

RESORT CHECK IN

Check-in time at most resorts is 3:00pm (local time). If you arrive prior to 3:00pm your room may not be ready. The resort will store your luggage in a secure location on property so you may start enjoying your vacation without delay. Change into something more comfortable and enjoy a nice lunch, swim in the pool, walk along the beach, etc. until you are notified that your room accommodation is ready for check in.

DRESS CODE

Please be advised that some resort restaurants may have a dress code. Please check with the resort restaurant ahead of time and pack accordingly.

FORCE MAJEURE

Travel With Class LLC will not be held responsible for any delays, changes, or cancellations caused by force majeure events or circumstances beyond its control. Force majeure events may include but not limited to natural disasters, political or civil unrest, strike, national or regional emergency, restrictions created by a government or public authority, or transportation disruptions.

COVID 19

As travel opens up around the world, all destinations, airports, air carriers, hotels, restaurants, transfer companies, car rental companies, shops and excursions have established COVID-19 safety measures and precautions which may change from day to day. These safety measures may include but are not limited to curfews, attraction closings and reduced hours, size of group gatherings, social distancing requirements, health screenings and self-quarantine requirements. In addition, you must follow CDC guidelines and the recommendations of health officials. Please note that any location where people have been or are present provides an inherent risk of exposure to COVID-19, and Travel With Class, LLC cannot guarantee that you will not be exposed during your vacation. By traveling, you agree that you assume these inherent risks associated with your vacation. Any and all additional costs will be your sole responsibility.

GENERAL

We reserve the right, in our sole discretion, to change these Terms at any time. Updated versions of the Terms will be provided to Clients, will be posted on our website and are effective immediately on posting.

The laws of the State of Wisconsin govern these Terms. You hereby consent to the exclusive jurisdiction and venue of courts in Washington County, Wisconsin in all disputes arising out of or relating to travel bookings or services with Travel With Class LLC.

If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

These Terms (and any other terms and conditions referenced herein) constitute the entire agreement between You and Travel With Class LLC with respect to travel bookings and/or services made with Trave With Class LLC by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between You and Travel With Class LLC with respect to communications with Travel With Class LLC. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
